Bicycle accidents in California can be caused by a number of factors, including careless drivers, dangerous roads, or defective bicycle and bicycle parts. The state’s personal injury laws allow for anyone injured in a bicycle accident to seek compensation from all parties potentially responsible for causing the accident. Grieving family members who lost their loved one in a bicycle accident can also seek compensation for their loss via a wrongful death claim.
According to a report published by the National Highway Traffic Safety Administration, 846 people lost their lives in bicycle accidents in 2019. Bicyclists run serious risks of catastrophic injury when colliding with a vehicle. Unlike cars, cyclists do not have sufficient bodily protection that can save their lives in an impact. Sadly, a majority of bicycle accidents are preventable as they are primarily caused by negligence.
Any person who is riding a bicycle is at risk of an accident when sharing the road with motor vehicles. Despite this, there are several factors that place cyclists at greater risk of injury or death. This includes the cyclist’s age and sex, whether a helmet was used, the time of day, whether alcohol was involved, and where the cyclist is traveling.
As previously mentioned, many bicycle accidents are caused by reckless drivers, but other conditions can also lead to an accident, including road conditions. Many cyclists can blame themselves when they get injured in an accident caused by potholes or other road degeneration. Based on the state’s premises liability laws, property owners and government agencies can be held liable for negligently causing the accident when they fail to maintain the road in reasonably safe conditions.
Common conditions that can lead to a bicycle accident include damaged road signs, lack of bicycle lanes, and insufficient street lights.
Bicycle accidents are dangerous and they can lead to catastrophic injuries that can wreak havoc in a person’s life. For the most part, an injured cyclist can file a claim against the responsible party for compensatory damages that include loss of wages and earning potential, medical expenses, disfigurement, trauma, and more. If the victim died as a result of the accident, the victim’s survivors can seek compensatory damages that include medical costs, funeral costs, burial expenses, loss of relationship, loss of household services, and more.
In California, only certain relatives have legal standing to file a wrongful death case following the death of their loved one. Family members who can seek compensation include immediate relatives, such as the surviving spouse or domestic partner, surviving children or grandchildren, and other parties who may have been entitled to the victim’s assets in accordance with the state’s intestate succession laws.
Every bicycle accident claim is subject to a strict statute of limitations. Generally, the statute of limitations is two years from the date of the accident. When the accident is believed to have been caused by a government agency, the statute of limitations is confined to only six months from the date of the accident. To ensure a claim is filed within the allowable time frame, proficient legal counsel should be obtained.
