Whenever a drunk driver causes a fatal accident, prosecutors may charge the reckless motorist with a crime. Aside from facing criminal charges, DUI drivers suspected of causing bodily harm to others can face civil claims filed by their victims. With a civil claim, injured victims can seek compensation for their injuries and losses, including pain and suffering, loss of income, and disability.
When a DUI accident causes the death of the victim, however, the deceased’s family members can seek compensatory damages on behalf of their loved one. This type of personal injury claim is referred to as a wrongful death claim.
The State of California has very strict rules regarding who can file the wrongful death claim. Generally, surviving spouses and registered domestic partners are given priority to bring a claim forward. Other family members who may be eligible to file a claim include the victim’s children, parents, stepchildren, and other dependents.
In order to achieve a successful outcome, every wrongful death claim involving a DUI driver should prove certain elements. The first element is to demonstrate that the at-fault driver owed a duty of care to the victim. In California, every motorist has a legal responsibility to drive carefully and avoid injuring others while driving.
The second element to demonstrate in a claim is that the driver breached his or her duty of care. When it comes to a DUI accident, this means demonstrating the driver was in fact intoxicated at the time of the accident.
Next, it is necessary to demonstrate that had it not been for the accused driver’s actions, the victim would be alive.
In a wrongful death claim, the plaintiff will need to prove that he or she has sustained quantifiable damages as a result of the fatal accident. These damages can include medical costs, funeral expenses, and loss of income.
If you have recently lost a loved one due to the reckless actions of another driver, it is important for you to know that you do not have to go through the claim’s process alone. After losing a loved one, it is completely understandable that it can be very difficult to even consider filing a claim. When it comes to wrongful death claims, however, time is of the essence. Vital information and important evidence can be lost with time. Additionally, the State of California has imposed a strict deadline to bring a case forward. Plaintiffs face debarment if they do not file the case in the time allowed.
After suffering the tragic loss of a loved one due to the recklessness of another driver, allow an experienced attorney to handle the investigation of the case and advocate on behalf of your family. The right attorney will build a strong case against the negligent driver and ensure he or she is held responsible for all of the losses incurred.
