Traffic accidents are a common occurrence across roads and highways in California but as common as these accidents are, no one is ever really prepared when an accident strikes, especially when the accident results in the death of a loved one.
Deadly traffic accidents can happen as a result of many different factors, but a common factor among most accidents is driver error. According to the National Highway Traffic Safety Administration (NHTSA), a vast majority of car crashes happen as a result of driver error.
Driver error can involve many characteristics in a person driving, but driving while distracted is a leading factor in causing deadly car accidents in California. The NHTSA reports that 20% of all people who lost their lives in traffic accidents died as a result of a distracted driver. Sadly, most victims are those who are vulnerable and exposed to the elements, such as bicyclists, pedestrians, and so on.
Aggressive and reckless driving is another leading cause of deadly auto accidents across the state. Unfortunately, the State of California is notorious for its congested roads and highways, especially during rush hour. The heavy amount of traffic routinely leads to aggressive driving, such as tailgating, speeding, improper passing, improper changes of lane, racing, and failing to yield.
In addition to driving aggressively, driving while under the influence is another common way in which people are driving recklessly. Sadly, drunk driving and driving while under the influence of legal or illegal drugs is a common cause of deadly car accidents. In the State of California, it is illegal for drivers to drive when under the influence of alcohol with a Blood Alcohol Concentration (BAC) over 0.08%. When it comes to drivers under the age of 21, the State of California has a “No Tolerance” policy, meaning when an underage person is found to be driving while intoxicated, no matter the percentage of BAC, this will result in an automatic DUI charge.
Traffic accidents are incredibly dangerous, no matter how seemingly small and uneventful they are and they often lead to fatal injuries. When a person tragically loses his or her life as a result of the accident, the fatal accident can bring about a slew of challenges for the victim’s surviving loved ones. Aside from the loss of their loved one, families may be left with difficult financial burdens brought onto them by the sudden passing. A few of the most devastating economic hardships include hospital bills, the loss of the victim’s wages and future earnings, funeral costs, burial bills, and more.
As a grieving surviving family member, knowing that the lethal traffic accident was caused by another’s negligence or intentional wrongdoing can be extremely difficult to experience. The State of California understands this and the financial hardships incurred by grieving family members. For this reason, the state allows certain family members the opportunity to recover monetary damages from the party that caused the accident. Through a wrongful death claim, surviving family members can hold the responsible party accountable for the financial burdens caused by the sudden and unexpected death.
If you have recently lost a loved one in a tragic traffic accident caused by a careless driver or other negligent parties, discuss the case with a well-versed wrongful death attorney who has experience in handling these difficult cases.
