The State of California has some of the highest rates of pedestrian accidents in the nation. This is a serious issue that has been steadily increasing for the last decade. A vast majority of these accidents are caused as a result of driver negligence, such as drunk driving.
According to a recent data sheet published by the University of Berkley’s SafeTREC, alcohol-impaired driving comprises a large percentage of all traffic injuries and fatalities across the nation. The National Highway Traffic Safety Administration reports that the likelihood of an accident increases when the driver, pedestrian, or both are intoxicated.
When a person is injured by a vehicle, the injuries sustained by the pedestrian can be catastrophic and these can result in exorbitant financial losses. In pedestrian accidents involving a drunk driver, the driver is likely to also be speeding at the time of the collision, which may only exacerbate the victim’s injuries. Injuries resulting from an accident caused by an intoxicated driver can include but are not limited to spinal cord injuries, head trauma, disfigurement, loss of limb, and internal organ damage.
Whether or not the accident was caused by a drunk driver, injured pedestrians in California are eligible for financial compensation when their injuries were caused by the negligence of another. Every driver in the state has a legal obligation to drive reasonably safe and prevent injuring those they share the road with. When a driver operates his or her vehicle while intoxicated, the driver is violating his or her duty of care to the safety of others. Therefore, drunk drivers can be held responsible for their negligent actions.
Unfortunately, drivers and their insurance companies will rarely pay injured victims what they need to cover their medical expenses after an accident. Often, victims and their families have to present strong evidence against the at-fault party to ensure they obtain the compensation they deserve. To build a strong case, victims have to demonstrate that the at-fault party owed them a duty of care, the at-fault party violated said duty, and this violation led to the accident. Finally, victims have to demonstrate that the accident was a proximate cause of their injuries.
To present a strong case, victims should collect evidence, such as photos taken at the scene of the accident, police reports, medical records, and proof of financial losses.
Sadly, many pedestrian accidents in California result in the death of the victim. The collection of evidence in these types of cases can be extremely difficult. Nonetheless, the families of those who perished still have an opportunity to recover from their losses with the support of a knowledgeable and experienced pedestrian accident attorney. With the right legal support, families can recover compensation for the loss of the victim’s income, funeral expenses, medical costs, loss of the relationship, and more.
Intoxicated driving is a dangerous decision that places hundreds of people at risk of injury in a single incident. When a person makes the conscious decision to drive while intoxicated and this results in the injuries of a pedestrian, the negligent driver must be held financially responsible for his or her actions.
If you or a loved one was recently injured in a pedestrian accident, contact the qualified support of an experienced personal injury attorney. The right attorney can help you navigate the intricate legal process and help you obtain the highest amount of compensation available.
