Losing a loved one can be an incredibly painful experience, but the experience can be even more traumatic when the person’s death was caused by the fault of another individual. When this happens, the victim’s family can be left to death with extreme emotional and economic distress. Fortunately, the victim’s family may be eligible for monetary compensation when the death of their loved one was caused because of another’s negligence.

In the State of California, a wrongful death lawsuit can be filed when an individual was killed due to the negligence of someone else. To pursue a wrongful death claim, it is necessary to demonstrate that the at-fault party’s negligent actions caused or in some way, contributed to the victim’s passing.

In California, one of the most common types of wrongful death cases is caused as a result of auto accidents. When a person is driving negligently, the death could be the cause of a wrongful death lawsuit. In addition, the person who is held liable in a wrongful death claim may also face criminal prosecution for his or her careless actions.

It is important to note that the State of California limits the amount of time a person has to bring a wrongful death claim forward. For the most part, the statute of limitations for wrongful death cases expires after two (2) years from the date of the accident. For this reason, it is very important to begin taking legal action right after the death occurred. When failing to abide by this deadline, securing any compensation for the victim’s death may be close to impossible.

Wrongful death claims can only be brought forward by specific family members. Based on California law, only close relatives or dependents can pursue compensation for the victim’s death. This can include spouses, domestic partners, and children. Under limited circumstances, there may be other parties who can pursue a claim on behalf of the deceased individual. This can include parents, nieces, nephews, and even parties who may have a right to the victim’s estate.

If you or someone you love was tragically killed in a traffic accident, it is important to know that a wrongful death claim can help alleviate the economic burdens presented by the wrongful death. For example, with a successful case, it may be possible to recover compensation that includes hospital bills the victim incurred before his or passing, loss of relationship, funeral expenses, burial costs, and more.
