Determining the liability of an accident can be typically straightforward, even when a motorcycle is involved. In a traffic accident involving a motorcycle, liability will usually come down to the party who was at fault or negligent. When the accident involves more than one vehicle, liability in a multi-vehicle accident will also usually concern those immediately involved.
Traffic accidents, however, can be caused by other factors aside from driver negligence and this includes motorcycle accidents. From a legal standpoint, determining liability becomes more difficult when the motorcycle accident was caused as a result of a vehicle defect.
Motorcyclists are unfortunately always at risk for serious injury the moment they get on their bike. Although most riders wear protective gear, follow all traffic laws, and practice defensive driving, riders are always susceptible to serious dangers. When a motorcyclist is involved in a traffic accident, he or she can sustain debilitating injuries that include spinal cord injury, traumatic brain injury, broken bones, road rash, internal injuries, and possibly death.
One of the most common defects in motorcycle accidents is brake defects. Defective brakes, the improper installation of brakes, and other maintenance-related problems can make riding a motorcycle extremely dangerous. Defective brakes on a motorcycle can make it nearly impossible to stop or slow down. Depending on the specifics of the case, such as the reason for the failure in the brakes, the motorcycle manufacturer, the parts manufacturer, and even the vehicle maintenance company that installed the brakes could be held responsible.
Similarly, tire defects can be a serious concern and can lead to catastrophic traffic accidents. In many cases, the defects in the tire involve the tread separating from the tire, which causes a tire blowout. When this occurs, most motorcyclists will be unable to maintain control of their vehicles.
A final less mentioned motorcycle defect involves fuel system defects. When there are issues with the vehicle’s fuel system, this can typically lead to fires and explosions. As a result of the exposed nature of the fuel system and its close proximity to motorcyclists, serious burn injuries can occur.
Every portion of a motorcycle is important and every component plays a significant role in the proper operation of the vehicle. When a motorcycle part has been installed incorrectly, is missing, or is made of low-quality material, the defect can pose a serious risk to the safety of the rider.
Determining liability for a motorcycle accident will require a thorough investigation of the facts. After a motorcycle accident caused by defective vehicle parts, the injuries sustained by the rider can be severe, therefore, it is important to identify all responsible parties. To hold these parties accountable and ensure maximum compensation is recovered, the support of a qualified personal injury attorney must be sought.
If you or someone you love was injured in a motorcycle accident involving a motorcycle defect, it is critically important to consider speaking to a proficient attorney who will advocate on your behalf. Depending on the severity of the injuries, it may be impossible to conduct your own investigations of the case. Additionally, an experienced attorney understands how to handle these complex cases and will know what is needed to build a strong case against the negligent party.
