Fiery Accident Caused by Road Rage in Rancho Cucamonga Leads to 1 Injury
Rancho Cucamonga, CA (March 17th, 2021) – On the afternoon of Thursday, March 17th, a child suffered injuries when involved in a fiery traffic accident that happened on the I-15 Freeway in Rancho Cucamonga.
The accident happened shortly before 1:10 p.m. on the southbound lanes of I-15, in a stretch of highway between 4th Street and Foothill Boulevard.
Based on preliminary reports, it is believed that the accident was caused as a result of road rage. The California Highway Patrol reports that a light-colored Toyota Scion and a Mitsubishi Lancer were both traveling at high speeds when one of the people involved threw a water bottle at the other.
As a result of the aggressive driving, the vehicles collided with one another. This caused the vehicles to spin and collide into the freeway’s center divider. Soon thereafter, the Toyota became engulfed in flames.
It is reported that first responders were dispatched to the scene of the fiery accident and fire crews worked quickly to extinguish the flames. Paramedics rushed a young passenger of the Mitsubishi vehicle to a nearby hospital. He was reportedly bleeding from his head.
The condition of the young boy is not known at this time. His identity is also unknown at this time.
Responding officers temporarily closed two lanes of the freeway. The cause of the accident is not known at this time.
Roads and highways in California can be riddled with heavy traffic and congestion. Drivers in the state have a legal obligation to drive safely and responsibly to avoid injuring themselves and others who may be on the road. Still, many drivers experience anger while driving and in turn, this results in serious accidents and fights that lead to serious injuries.
Any person who has spent a significant amount of time behind the wheel will understand how frustrating driving alongside other drivers can be. Nearly every driver in California has experienced being cut off by another driver, which happens when another driver enters the lane without providing a signal or properly checking before merging. Although becoming frustrated at the dangerous actions made by other drivers is normal, it is very important to remain calm and in control of an already dangerous situation. Getting angry while behind the wheel can quickly turn a seemingly minor situation into one that results in catastrophic injuries or even death.
According to a report published by the National Highway Traffic Safety Administration, a total of 1,350 traffic accidents between 2009 and 2014 were attributed to road rage and aggressive driving. In these accidents, approximately 1,500 people lost their lives. The agency also reports that road rage leads to 66 percent of all traffic accident-related fatalities. When it comes to aggressive driving, firearms have been used in roughly 37 percent of all incidents. It is also reported that male drivers under the age of 19 are more likely to engage in aggressive driving.
When an aggressive driving accident occurs, the reckless drivers who caused the accident should be held responsible for the trauma and injuries they cause to innocent drivers and bystanders. Depending on the facts of each individual case, it may be possible to seek compensation for the medical expenses incurred, future medical treatments, loss of income, loss of earning capacity, emotional distress, loss of quality of life, and more.
In order to win a case, however, it is important to establish liability in the case.
Unlike distracted driving, aggressive driving usually indicates a person’s intentional negligence. Under the California Vehicle Code §23103, reckless driving is defined as the willful disregard for the safety of another person. To establish the behavior as being aggressive, it is necessary to elaborate on the driver’s intentional violation of traffic laws. A few examples of road rage include inappropriate passing, street racing, abrupt braking, tailgating, and speeding.
The question of liability, however, is a complex one. The State of California adheres to the Comparative Negligence Rule, meaning when a person is involved in an accident and is seeking monetary damages, his or her degree of fault in causing the accident will affect the amount received if any.
For instance, if a driver was the victim of an accident that also involved him or her as the aggressor, the court may find this driver 50 percent at fault for the accident. In California, claimants seeking compensation can still recover damages even when found partially responsible for the accident.
If you or someone you love was recently hurt in an accident involving road rage, it is important to take quick action to establish the facts of the case. To build a strong case, a skilled attorney will ensure the case is thoroughly investigated, all critical evidence is collected, and all potentially liable parties are held responsible.
