Undoubtedly, pedestrians have a lot more to lose in a collision with a moving vehicle. People do not have the same protections a driver may have inside a vehicle and for this reason, even upon the slightest impact, the force of an auto vs. pedestrian collision can prove catastrophic for the pedestrian. While a vast majority of people understand the risks of a pedestrian accident, pedestrian accidents are on the rise across California.
For the past several years, the State of California has had some of the highest rates of pedestrian accident-related deaths in the nation. Many of these unfortunate tragedies are caused by drunk drivers, distracted drivers, or other forms of reckless driving. In order to protect people while they are out on the street, the state has continued to move toward building better and safer roads and has also passed strong right-of-way laws.
Still, the California Office of Traffic Safety reports that pedestrian accident rates continue to rise. By far, driving while distracted is a major cause for concern as it causes millions of accidents across the state. While this is a common cause of pedestrian accidents, it is not the only contributing factor to these types of accidents. Pedestrian accidents can also be caused by intoxication, malfunctioning road signs, speeding, defective vehicle designs, and more.
Injured pedestrians can obtain monetary compensation after being struck by a motor vehicle when the accident was caused as a result of another party’s negligence. Establishing liability in the accident will depend on the specifics of the accident. Whether it was the person driving the vehicle, the government agency responsible for managing the road where the accident happened, or the vehicle manufacturer, it is important to secure important evidence to prove the case.
After being struck by a vehicle, many accident victims may be incoherent or may lose consciousness. To build a strong case after an accident, however, it is important to collect key pieces of evidence. These pieces of evidence may not only avoid disputes in liability, but they may also lead to higher settlement offers.
Shortly after an accident, it is important to call the police and obtain a police report. A police report can sometimes confirm and validate a person’s account of how the accident transpired. In addition, the report may highlight whether or not the driver was cited for any traffic law violations.
Further, photos of the accident scene and injuries are also important. Pictures can also be taken of any property damage, road conditions, as well as weather conditions. Moreover, writing down the contact information of eyewitnesses can be beneficial. Witness testimony that can corroborate a victim’s version of events can be an invaluable resource to have in a lawsuit.
After being struck by a moving vehicle, injured pedestrians must immediately seek medical treatment. Allowing a medical expert to evaluate and treat the injuries will prevent a worsening of the injuries, especially when it comes to internal injuries.
Unfortunately, many injured victims fail to understand the importance of following a medical provider’s instructions and miss subsequent appointments. Obtaining medical care immediately after an accident is important, but maintaining doctor appointments is equally, if not more important. Whenever an accident claimant neglects their injury, this can jeopardize the case and could result in a denial of damages.
In the State of California, every driver owes a duty of care to those they share the road with. When drivers breach the duty of care as a result of negligence or intentional wrongdoing and this led to the accident that caused the victim’s injuries, the victim has a legal right to obtain compensation from the driver.
All traffic accident claims are challenging and every case can be contentious, including pedestrian accidents. Even when a driver has struck a pedestrian, the driver can challenge their liability for the accident and even attempt to shift the blame to the pedestrian. For this reason, it is very important that injured pedestrians seek the immediate support of a qualified personal injury attorney who has the skills and resources necessary to aggressively advocate on their behalf.
Personal injury attorneys with experience in handling pedestrian accident claims can help victims gather vital evidence, such as eyewitness reports. Skilled attorneys can also communicate with the other party and their insurance company, ensuring the highest amount of compensation is negotiated. If you or someone you love was recently injured in a pedestrian accident, obtain the support of an attorney you can depend on.
