One Person Fatally Wounded in Motorcycle Accident in Rancho Cucamonga
Rancho Cucamonga, CA (November 5th, 2020) – A man was fatally wounded after his motorcycle was struck by another car in Rancho Cucamonga.
According to Rancho Cucamonga authorities, the accident occurred at about 5:00 p.m. on November 5th at the intersection of Spruce Ave. and Base Line Rd.
The motorcyclist was traveling east along Baseline when he was struck by a pickup truck traveling westbound. The pickup truck driver made a sudden left turn onto Spruce Ave., which prompted the collision with the motorcyclist. Based on preliminary investigations, it is still not known why the driver of the pickup truck made the sudden left turn.
The motorcyclist, later identified as 55-year-old Clifton Ray Vandiver, suffered fatal injuries from the collision. Vandiver was pronounced dead at the scene by authorities.
Further details regarding the tragic collision were not immediately available. The motorcycle crash is under investigation by the California Highway Patrol. Anyone with information is asked to contact the department.
The National Highway Traffic Safety Administration reports that motorcyclists are 16 times more likely to be injured and about 35 times more likely to be fatally injured in an accident compared to drivers of regular passenger vehicles. These rates are exponentially higher when the rider is younger and inexperienced.
Motorcycle accidents can happen for many different reasons, but when the accident is caused by another’s negligence, the at-fault party can be held responsible for the rider’s injuries. In California, negligence is usually defined by the failure to act with the level of care that another party would have, given similar circumstances. Riders who are injured as a result of a reckless driver can seek financial compensation through a personal injury claim. To achieve a successful claim, it is important to provide certain elements, referred to as a preponderance of the evidence. Without these claims, obtaining a damages award would not be possible.
The first element required in a strong personal injury claim is establishing that the defendant had a legal duty to act in a certain manner toward the injured rider. Establishing the at-fault party’s legal duty to the rider can be easy when the at-fault party was another driver. In the State of California, all drivers have a legal responsibility to drive carefully, follow traffic laws, and avoid the injury of others on the road.
The second element necessary in a claim is referred to as a breach of duty of care. This element can be easy to establish when the at-fault party was a driver who broke the law at the time of the accident. For instance, a driver who was found to be under the influence at the time of the accident will be considered negligent and would have violated his or her legal duty of care.
Next, injured riders seeking to file a claim for damages will need to prove that the at-fault party actually caused their injuries and losses. This element, referred to as cause-in-fact or but-for, refers to demonstrating that if it was not for the actions of the at-fault party, the injuries of the rider would not have occurred.
One important element is the proximate cause, which means that the responsible party will only be held legally and financially responsible for the losses caused in the foreseeable accident. In a majority of accident cases, serious injuries and certain losses are considered to be foreseeable repercussions of reckless driving and the proximate cause can be established.
Finally, the injury claim must demonstrate that the accident resulted in damages, usually in the form of bodily harm, economic losses, and property damage.
A well-versed personal injury attorney can gather the evidence needed to establish all required elements needed for a successful claim. If you or someone you love was injured in a motorcycle accident, take immediate action and contact an experienced attorney right away. Certain evidence can be lost after the accident, but obtaining proficient legal counsel from a knowledgeable attorney will ensure all evidence needed for the case is secured.
