2 People Killed in Wrong-Way Driving Accident Involving Tesla in Ontario, CA
Ontario, CA (March 14th, 2022) – According to the California Highway Patrol, two occupants in a Tesla that was traveling in the wrong direction of the 15 Freeway in Ontario died over the weekend.
Based on reports, the Tesla made a U-Turn while on the freeway before the accident happened. Consequently, the vehicle was headed north while in southbound lanes. CHP Officer Rawls stated that the accident occurred near where the 10 and 15 freeways meet. Officers from the California Highway Patrol were sent to the scene of the accident, which happened around 3:15 a.m. on Saturday.
A preliminary report suggests that the Tesla was traveling at excessive speeds when it crashed head-on with a concrete rail known as a k-rail, which was used to divide the northbound and southbound lanes, stated Officer Rawls. The individuals inside the vehicle were both killed in the accident.
The San Bernardino County Coroner’s Press Release has identified the driver of the Tesla as Jose Elizarraraz, a 24-year-old resident of Rialto. The second person who died in the accident has also been identified by the press release. He has been identified as Luis Elizarraraz Bravo, a 29-year-old who was also a resident of Rialto.
There were no other vehicles involved in the collision.
At this time, it is not known whether alcohol, drugs, or other substances played a role in the accident. It is also not known whether a mechanical failure contributed to the cause of the accident. Authorities continue to investigate the accident.
Self-driving motor vehicles are an attractive idea for many people – you sit back and relax as the vehicle drives you to your destination. At the forefront of automated driving systems is Tesla, an electric vehicle automaker that has made history by releasing one of the first autonomous driving vehicles to the general public. The vehicle manufacturer has been offering fully autonomous driving capabilities to drivers for a $10,000 upgrade to their vehicles.
Like most things in life, self-driving vehicles are not flawless. There have been many fatal traffic accidents that involve these autopilot systems, which have prompted investigations from the National Transportation Safety Board (NTSB). The board is currently looking into the safety and viability of Tesla’s vehicle designs.
In order for a Tesla to operate in autopilot, there are two systems that have to operate simultaneously. One is the Autosteer System and the second is the Traffic-Aware Cruise Control System. According to a preliminary investigation report published by the NTSB, the board found that in a recent fatal accident in Texas, only the Traffic-Aware Cruise Control System was engaged when the accident occurred. It was discovered that the Autosteer System was not available on the stretch of road where the accident occurred.
The National Transportation Safety Board’s investigations reveal that the autopilot systems found in Tesla vehicles may not be entirely safe for complete autonomous travel that is without human intervention. Anytime vehicle safety issues are present, vehicle manufacturing companies may face liability after an accident.
Currently, there is growing controversy behind self-driving vehicles made by Tesla. The company claims that its Full Self-Driving System provides drivers with active guidance as well as automatic driving, but under the active supervision of drivers. This is made possible through various built-in features found in their vehicles, which include Smart Summon, Autopilot, Autopark feature, and Auto Lane Change.
Although Tesla claims that its Full Self-Driving System is not entirely autonomous, it remains unclear whether there are enough safety features to prevent a person from misusing the vehicle systems or committing negligence when driving, even if it is done inadvertently.
According to a recent publication published by the Business Insider, the question was raised as to whether Tesla vehicles with Full Self-Driving Systems are at all safe since there are flaws to the system and there are potential dangers in the system prototypes.
As a result of the growing concerns, automated driving systems are taking mounting criticism from safety experts, lawmakers, and customers alike.
When a person is injured in an auto accident involving a self-driving vehicle, monetary compensation could be obtained from the vehicle maker. Depending on what caused the accident, the manufacturing company can be held responsible for the victim’s hospital bills, future medical procedures, medications, loss of employment, loss of quality of life, and more.
Regrettably, not every person survives an automated driving accident. When the passengers of a self-driving vehicle die in an accident caused by a defect in the vehicle’s systems or design, the victim’s survivors can pursue monetary damages on behalf of their loved ones. Contingent on the facts of the case, successful wrongful death lawsuits may provide damages that may include hospital bills, loss of the victim’s expected income, loss of the relationship, and more.
In the State of California, accident victims and surviving loved ones must take quick action to file an accident claim. Under California Civil Code §§335.1 and 337.60, claimants have 2 years from the date of the accident or date of the victim’s passing to bring the case forward.
In auto accidents involving automated driving vehicles, it is important to obtain the legal support of a proficient attorney who is well-versed in handling the complex investigations these accident cases demand. Self-driving vehicles are incredibly complex and it may be possible that multiple parties could face financial liability for an accident.
