Southern California’s roads are among the busiest in the nation, and sadly, this also makes them some of the most dangerous. In a split second, even the most careful drivers can get involved in a multi-vehicle accident that results in serious injuries. Aside from the serious injuries, the collision can lead to extensive property damage, pain and suffering, emotional trauma, loss of quality of life, and long-term financial insecurity. Fortunately, most accident victims can obtain financial compensation for their grievances by pursuing legal action against the at-fault party.
When multiple vehicles are involved in the accident, figuring out what party is at fault for causing the accident can be a real challenge. With a thorough case investigation, however, it may be possible to determine who was at fault and if multiple parties share liability for the accident.
The State of California observes the theory of comparative fault in most accident cases, including car accidents. For the most part, this means that every party involved in the accident can be held responsible for his or her contribution in causing the accident. Even the injured person filing the claim can bear responsibility for the accident. If the court finds the victim partially responsible for the accident, the damages awarded to the victim will be reduced by the percentage he or she was found responsible for.
The same theory applies in cases where the victim lost his or her life in the accident. When the victim’s family files a wrongful death claim against the responsible party, the court may reduce a fraction of the damages awarded if the victim was found to be partially at fault for the accident.
Whether or not injured people share responsibility in causing an accident, filing a claim can provide much needed compensation to cover expenses stemming from the accident, such as the loss of income, disability, and trauma. By obtaining efficient legal counsel, injured victims can ensure their case is stronger; therefore, ensuring the highest amount of compensation is secured.
If you or a loved one was seriously hurt in a multi-vehicle accident, building a strong injury claim against the at-fault party can be difficult. Discuss your case with a knowledgeable attorney who will take immediate action in preserving critical evidence to present an effective and robust personal injury claim.
