When a loved one is tragically killed in a car accident, the pain, grief, and emotional trauma experienced by the victim’s survivors can be overwhelming. Sadly, families who lose a family member in a car accident often suffer significant financial difficulty, both immediately after the accident and in the future. A few examples of their financial challenges include the victim’s medical care costs prior to his or her passing, funeral expenses, and a loss of the victim’s future earnings. The pain and grief the victim’s loved ones may endure can be incalculable.
In the State of California, a wrongful death case can arise when the careless, negligent, or intentional actions of a party leads to the death of a person. Although not every accident-related causality will be considered a wrongful death, most are.
Wrongful death lawsuits are civil actions brought forth by the victim’s surviving loved ones when the negligent actions of another caused the death of their loved one. These cases are separate from a criminal court. When liability is successfully proven in a wrongful death lawsuit, the victim’s loved ones will receive monetary compensation for their losses. Common examples of monetary damages received in a successful claim include medical costs, funeral expenses, emotional trauma caused by the death, and a loss of the victim’s future earnings.
Successful wrongful death cases have three different elements that should be satisfied in the claim. In California, the following elements must be established so that the victim’s family can receive monetary compensation. These are 1) the death of the person; 2) the death was caused by another’s intent to cause harm or negligence; and 3) the family is suffering financial hardship because of their loved one’s passing.
California’s wrongful death statute states that only eligible family members can file a claim on behalf of the victim. These may include the victim’s spouse or partner, parents, children, or dependents. Additionally, the law also restricts the time the victim’s family can file the claim. Currently, the state’s statute of limitations for wrongful death claims is two years from the date of the victim’s passing. The claim, however, should be commenced immediately after the accident as important evidence could be forever lost.
If you have tragically lost a loved one in a car accident, it is crucial that you obtain the qualified support of an experienced personal injury attorney. Having a knowledgeable legal representative on your side will ensure you recover the highest compensation available.
Why Do You Need A Skilled Attorney?
A skilled attorney will conduct a thorough investigation of the accident, which will help to determine the exact cause of the accident and will also serve to secure necessary evidence to build a strong case. With the support of a proficient and compassionate attorney, achieving justice on behalf of the victim may be possible.
Although compensation from a wrongful death lawsuit will never make up for the loss of a family member, the damages award can ease the financial burdens associated with the tragic and unexpected passing. Discuss your case with an experienced personal injury attorney who can advocate on your behalf and ensure you secure the compensation you and your family deserve.
