Pedestrian accidents are happening at alarming rates in California and according to the California Office of Traffic Safety, the problem is only getting worse. With more people headed out for a walk to get to school, work, shopping, or for leisure, the rate of pedestrian accidents has dramatically increased. According to the agency, there was an almost 30 percent increase in pedestrian accident fatalities in California between 2014 and 2018.
Pedestrian accidents are a huge concern for the state and unfortunately, it is a difficult problem to control because there are many factors that contribute to these accidents. To begin, pedestrians cannot depend on the same protections a driver can when traveling in a car. Drivers can rely on the exterior of the vehicle for protection in an accident, including the protections provided by the vehicle’s airbags.
Aside from a lack of protection, pedestrians are at risk whenever they are near moving vehicles. A vast majority of pedestrian accidents are caused by driver errors, which include negligent actions like speeding, driving under the influence, drowsy driving, and aggressive driving behavior. Although pedestrians have a responsibility to look out for their safety and follow the rules of the road, motorists have an even greater duty of care to prevent a pedestrian accident from happening. Even when a pedestrian contributed in some form to the cause of his or her injuries, it is likely that the motorist will bear some degree of fault in the accident as well.
In California, injured pedestrians can pursue legal action against negligent drivers for compensation. Likewise, a pedestrian’s close relatives can seek legal action against negligent drivers when the pedestrian died as a result of his or her injuries.
To receive monetary compensation after a pedestrian accident, the plaintiff in the case will need to meet certain elements, including establishing that the driver owed him or her a duty of care and that the driver breached his or her duty of care. Additionally, the plaintiff will need to demonstrate that the breach in duty caused the pedestrians injuries and/or death. Finally, the plaintiff will need to provide evidence of the damages sustained as a result of the accident.
Pedestrian accidents are on the rise in the State of California and even when pedestrians take reasonable precautions, they can still be struck as a result of a driver’s negligence. When a person is struck by a vehicle, the consequences can be devastating to the injured person and his or her family. Depending on the severity of the impact, the accident can result in catastrophic injuries or even death.
