According to California’s laws, wrongful death accidents are defined as unintended casualties caused as a result of another’s negligent actions or recklessness. When it comes to wrongful death accidents, the accident may be the fault of another driver, the motor vehicle manufacturer, or even the government agency responsible for maintaining the road where the accident took place.
Wrongful death cases are not criminal cases, and they do not involve sending the offender to jail. In place of this, wrongful death accidents involve filing a lawsuit against the party responsible for the accident. The purpose of the claim is to pursue financial damages to compensate the family for the losses incurred as a result of the victim’s death. Among the damages available, compensation can also be obtained for the family’s loss of companionship along with the victim’s pain and suffering the accident may have caused before he or she succumbed to his or her injuries.
Every state has its own laws regarding how or when a wrongful death claim can be filed. In California, the victim’s family has a maximum of two years to bring a wrongful death case forward. Once the statute of limitations has expired, the victim’s family will no longer be able to hold the accused party responsible, even if there is sufficient evidence against the accused party.
Additionally, it is important to understand that not everyone is entitled to file a claim for their loved one’s passing. Based on the state’s wrongful death laws, only close relatives have legal standing to bring a case forward. This includes the victim’s spouse or domestic partner, children, parents, and grandparents. If none of these parties are available, any person who was financially dependent on the victim may have an opportunity to file the wrongful death claim.
Depending on the specifics of the case, filing a wrongful death claim may require a thorough investigation. While it may be easy to identify the culpable party in certain cases, in other cases, identifying the liable party may be far more complex. For instance, when the accident involves a defective auto part, identifying the defective part and the responsible party may require a full auto body inspection. Cases involving a defective auto part may involve the automaker, auto designer, auto part manufacturing company, and even the vehicle seller.
If you have lost a loved one as a result of a car accident, it is critically important that you seek proficient legal counsel. An experienced attorney will be able to conduct all investigations on your behalf and make sure your case is filed before the statute of limitations expires. Additionally, a proficient litigator will aggressively advocate for maximum compensation on your behalf.
