Pedestrian Fatally Struck on the 10 Freeway in Ontario, CA
Ontario, CA (September 30th, 2020) – A pedestrian was tragically killed after being struck by multiple vehicles on the I-10 in Ontario late Sunday, September 27th according to the California Highway Patrol Rancho Cucamonga office.
The CHP reports that around 11 p.m. officers responded to 9-1-1 calls from drivers witnessing a pedestrian walking on I-10 traffic lanes, east of Haven Avenue. Subsequently, the pedestrian was struck by a motorist who was driving within traffic lanes headed east on the I-10 and was later struck by various vehicles across all lanes in the freeway.
The victim succumbed to his injuries and was pronounced dead at the scene. The CHP of Rancho Cucamonga continues the investigation at this time and is requesting anyone with additional information to contact them.
Pedestrian accidents are occurring at alarming rates throughout the country. According to data published by the National Highway Traffic Safety Administration, traffic accidents involving pedestrians have been increasing since 2009. The agency also reports that as of 2015, pedestrians are injured in traffic accidents every 7.5 minutes. When a pedestrian is struck by a vehicle on a high-speed road, the agency reports that the person is more likely to suffer fatal injuries.
Pedestrian accidents can be caused by various forms of driver negligence, including drunk driving, distracted driving, and speeding. In fact, according to the Centers for Disease Control and Prevention, roughly 50 percent of all pedestrian fatalities involve intoxication. In spite of this, it is important to recognize that pedestrian accidents can also occur as a result of other factors, including careless bus drivers, a lack of accessible walkways, and insufficient lighting. When a person is injured because of a lack of care by another, the State of California protects his or her right to seek monetary compensation from the negligent party. If the pedestrian is fatally injured in the collision, his or her surviving loved ones can seek monetary compensation on his or her behalf.
Unfortunately, a vast majority of pedestrian accidents result in catastrophic injuries that ultimately affect victims in many areas of their personal lives. When a person is struck by a vehicle, the most common injuries he or she may sustain include traumatic brain injuries, spinal cord injuries, broken bones, and facial injuries. Even with the use of a helmet, a pedestrian can suffer severe head trauma. Those who sustain any of these catastrophic injuries can face a lifetime of chronic pain, permanent disability, and financial loss.
It is critically important to understand that when a person has been injured as a result of another’s negligence or wrongdoing, there is an opportunity to seek compensation by filing a personal injury lawsuit against the culpable party. Depending on the facts of the case, a successful case can help an injured pedestrian cover the following economic expenses: medical costs, the need for ongoing medical treatment, the loss of income, and the loss of an earning capacity. Additionally, injured pedestrians can also seek non-economic damages that include pain and suffering, loss of enjoyment of life, disability, disfigurement, and loss of quality of life. Enumerating some of these damages can be difficult, especially damages that involve intangible non-economic losses. For support in calculating these damages and to ensure a full compensation is obtained, it is imperative to seek the legal guidance of a knowledgeable personal injury attorney.
If you or a family member has been seriously injured in a pedestrian accident, it is highly important to seek the professional legal guidance of an experienced attorney. A knowledgeable attorney will conduct a complete investigation that can help you enumerate the damages you are owed. A skilled personal injury attorney can also assist in establishing liability, even if multiple parties are involved. Finally, a proficient attorney will ensure a maximum compensation is secured.
