A Substantial “6 Figure” Arbitration Award for our Client
The Law Office of Justin H. King is very pleased to announce that we were able obtain a substantial “6 figure” arbitration award for our client who suffered a wrist fracture to her non-dominant hand. The injury was the result of a traffic collision in which another motorist pulled in front of our client. Initially we brought suit against the negligent driver, but unfortunately that driver had no insurance coverage.
Our client did however hold an insurance policy which included “Uninsured Motorist Coverage”. Their initial settlement offer for our client was far too low to compensate for the damages sustained. We then took the case to mediation at which time the insurance company did not raise their offer to a level fair enough to compensate for the injuries suffered.
We then demanded an arbitration where we presented a solid and verifiable case on our client’s behalf. We called one of the best hand and wrist surgeons in Southern California to speak to the full scope of our client’s injury. Also presented was documentation to support our client’s impairment at work.
This award was the result of a long and arduous fight with our client’s auto insurance company who refused to recognize how our client’s injury had affected them. The award we obtained for our client was substantially more than the insurance carrier was offering and it took us over a year to pursue this action on our client’s behalf and required extensive discovery and the retention of medical experts and well organized documentation.
Although our client’s insurance company never wanted to fully compensate our client, thankfully, after putting together a great case for our client, the arbitrator saw through the insurance company’s inadequate offers and came back with a substantial 6 figure award that fully compensated our client for the injuries. It was an honor to represent our client in this matter and we are so pleased that we could obtain justice.
This example, aside from being a victory for our client, is a great reminder that when serious or traumatic injuries occur, an experienced injury attorney can work within the legal system to gain a more favorable outcome for their client’s. Had our client not sought out representation to protect their rights, the insurance company would have cut a check, and closed the claim. While the mediation process, and then arbitration did take longer than a quick settlement, our client recovered considerably more compensation in the end.
No matter the injury, or how a person thinks it has bearing on their current life, experienced injury attorneys can often shed light on the full impact and implications. They can provide a better understanding of the process, what to expect and ways in which a claim can potentially be more beneficial when they stand up to insurance companies. Every injury and claim is different, and for this reason it is crucial to seek legal representation immediately to understand your rights, and further protect them from those looking to disregard them.
