According to data compiled by the California Office of Traffic Safety, no other state in the nation has more pedestrian accident deaths on its roadways than the State of California. Whether a person is walking to school or work, jogging, or is out just for fun, being out in a place shared with motor vehicles is becoming increasingly dangerous.
In 2018, there was a 26 percent increase in the number of pedestrian accidents from 2014. In 2018, there were 893 pedestrian fatalities and more than 14,000 non-fatal injuries. Pedestrian accident rates are a very serious issue in California, with millions of people at risk each day.
There is a multitude of factors that contribute to pedestrian accidents, including infrastructure conditions and adverse weather. Nonetheless, the most common cause of pedestrian accidents comes down to driver negligence. Drivers in California have a duty to drive safely and carefully, which means they have to be mindful of the road and remain vigilant of those around, including pedestrians. When a driver fails to drive safely, he or she could be held accountable for the fatal or non-fatal injuries of the person struck.
Driver negligence can vary, such as intoxicated driving, failing to yield for a pedestrian or speeding. No matter the form of negligence, reckless drivers can be held accountable when they injure or kill a person who is walking on the street. As a result of California’s personal injury laws, injured pedestrians can recover compensation for their harms, including medical bills, loss of wages, and emotional distress.
Unfortunately, some pedestrian accidents result in fatal injuries. When a person dies after being struck by a vehicle, the victim’s family has the right to pursue monetary damages on behalf of the victim. Through a wrongful death lawsuit, compensation can be obtained for the victim’s medical expenses incurred after the collision. In addition, the victim’s loved ones can receive compensation for the victim’s funeral expenses and burial costs. Finally, monetary damages can be obtained for the loss of companionship, loss of the relationship, and/or the loss of consortium.
The type and amount of damages recoverable will depend on the facts of the case. Those seeking to file a case must speak to a well-versed attorney who has experience in pedestrian accident cases. A skilled pedestrian accident attorney will take immediate action in investigating the case, securing important documentation, and aggressively pursue the highest compensation available.
