Woman Is Tragically Killed on the 210 Freeway in the City of San Bernardino
On Wednesday, July 29th, a woman standing outside her disabled car on the 210 Freeway in San Bernardino was tragically struck and killed by a man suspected of driving while under the influence.
Sadly, when a person is injured in a car accident, rarely will he or she be the only person affected. A majority of car accident cases will also affect the lives of family members and close friends of the victim. This is particularly true when the victim has succumbed to his or her injuries.
According to the California Office of Traffic Safety, there were 1,069 fatal traffic accidents caused by drunk driving in 2018, a 7% decrease from data collected in 2019. Although there has been a significant decrease in fatal traffic accidents caused by drunk driving, drunk driving continues to cause many catastrophic injuries every year.
When a drunk driving car accident happens, there are a myriad of injuries a victim can suffer. Some of the most significant factors that can play a role on the extent of injuries a victim sustains includes the speed of the vehicles traveling at the time of the accident, the age of the victim, and whether the victim was in use of a seatbelt.
California’s Vehicle Code §23152 defines traffic offenses involving drugs and alcohol. The statute states that it is unlawful for drivers over the age of 21 to be driving with a Blood Alcohol Concentration, or BAC, of 0.08% or higher.
Unfortunately, drunk driving continues to be a serious issue in the State of California, and while not every accident will lead to fatal injuries, many drunk-driving accidents can lead to serious, life-altering injuries.
Some of the most common injuries a victim can sustain include:
- Back Injuries – A person who has suffered a back injury can undergo debilitating pain. When the injury is a spinal cord injury, the victim can suffer paralysis to major areas of the body.
- Head Trauma – Head trauma is one of the most serious injuries a person can sustain. These injuries can range dramatically from mild concussions to permanent brain trauma. Regrettably, when a person suffers a traumatic brain injury, symptoms may not become immediately recognizable until the injury has dramatically progressed. For this reason, it is very important that victims seek medical attention immediately following an accident. By obtaining a complete medical evaluation, the victim can prevent serious permanent damage or even death.
- Neck Injury – Whiplash is by far one of the most common injuries sustained in a car accident. The injury occurs when there has been a sudden snap motion of the head and neck upon impact. Whiplash can leave a victim with strained muscle pain, torn ligaments, and it can cause difficulty in moving.
- Fractured Bones – Following an auto accident, it is not uncommon for victims to sustain broken bones in the feet, legs, arms, and/or hands. When a person suffers a crushed bone injury, treatment will require years of rehabilitation and multiple surgeries. Nonetheless, the ability to fully recover will be miniscule.
In some cases, a bone injury can lead to a life threatening infection, where the auto accident victim may need to have affected limbs amputated. After an amputation, the injured victim will face life-long challenges.
- Chest Injuries – Auto accident victims, especially drivers, can suffer bruised and/or broken ribs, which often take many weeks to heal. Suffering a broken rib can also lead to a lung puncture along with other internal organ damage.
Obtaining compensation in the aftermath of a drunk driving accident is necessary when serious injuries have been inflicted. If you were injured in a car accident caused by a careless drunk driver, taking immediate action in preserving evidence is one of the best ways in protecting your right to a maximum compensation.
In many cases, a person who has been seriously injured in an auto accident will be physically unable to collect important evidence. The preservation of evidence immediately after an accident is critical as evidence can be eradicated moments after the accident. Whether or not this is your situation, obtaining the support of a qualified attorney will ensure the preservation of important evidence. A dedicated attorney will work aggressively in defending the victim’s right to a fair compensation. Talk to an attorney who will help you obtain the compensation you need to make a healthy recovery.
